The injury risk
In 2013, Atrium issued Class II recalls for over one hundred thousand units of its C-QUR (pronounced "secure") products, including C-QUR V-Patch Mesh, C-QUR Edge Mesh, and C-QUR TacShield Mesh. The recall technically targeted the product's packaging, not the actual mesh itself. The stated issue was that the Omega-3 fish oil gel coating on the mesh could peel off and stick to the inside of the package in high-humidity conditions.
Unfortunately, this issue with the fish oil coating not only presents problems while the mesh is in its packaging, but also inside a patient's body. The mesh is not meant to come into direct contact with the patient's organs, and the coating is intended to prevent it from doing so. Dozens of lawsuits have alleged that the loss of coating inside a patient's body has caused serious injury.
Lawsuits have also claimed that the fish oil coating produces an allergic or inflammatory reaction that causes severe complications.
Atrium's failure to protect patients
The legal issues surrounding the C-QUR Mesh involve several different errors on the part of the manufacturer:
- Lawsuits have alleged that Atrium marketed C-QUR as safe and effective for use in surgery without ever conducting a clinical study in humans.
- Atrium has also been cited for poor manufacturing practices that have resulted in ostensibly "sterile" products being contaminated. Lawyers for the victims have alleged that the fish oil coating requires a "dry" sterilization process which is inadequate to prevent certain infections.
- Lawsuits have also alleged that Atrium conducted a "stealth recall" of the C-QUR Mesh by merely halting production without informing doctors or patients of the risk of side effects - even though the company knew those risks were high.
As a result of this alleged negligence on Atrium's part, numerous patients have suffered severe complications. Often, patients have required additional revision surgery to remove and replace the defective mesh.
